General Terms and Conditions (GTC) of the TestSolutions Academy

These "General Terms and Conditions for the Organization of Open Seminars" (GTC) are binding for contracts between TestSolutions GmbH, Georg-Voigt-Straße 17, 60325 Frankfurt am Main (hereinafter referred to as "TestSolutions") and the registering customer (hereinafter referred to as "Customer").

§1 Registration

The Client may only register for a seminar in writing (by post, fax or e-mail), via the website www.qualitydojo.com or via a third-party platform provided for this purpose.

The registration only becomes binding with a written order confirmation from TestSolutions (by post, fax or e-mail).

The client can register one or more seminar participants (hereinafter referred to as "participants") with one registration. By registering, the client accepts these GTC.

§2 Fees

All prices are per person in euros plus statutory VAT.

Invoices will be issued approximately four weeks before the seminar date. The seminar fees are due within seven days of receipt of the invoice without deduction.

§3 Services

Unless explicitly agreed otherwise at the time of registration, the seminar fees include the costs of the necessary seminar documents as well as refreshments during breaks and lunch. Expenses incurred by a participant for certification examinations, travel to and from the seminar, accommodation and transfers at the training venue are not included and will be shown separately if they can be booked via TestSolutions.

§4 Deviations

The receipt of an order confirmation does not constitute a legal claim that the seminar will take place on the confirmed date. TestSolutions reserves the right to make changes to the location, the trainer and minor changes to the seminar content.

TestSolutions reserves the right to cancel individual courses for organizational reasons or to postpone them to another date (e.g. if the instructor is unable to attend at short notice due to illness or if the minimum number of participants for a seminar is not reached). In this case, any seminar fees already paid by the customer will be refunded in full. In the event of a postponement, the participant can attend the new date under the same conditions.

TestSolutions also reserves the right to cancel a certification examination following the seminar, irrespective of the seminar. In this case, any fees already paid by the customer for the certification examination will be refunded in full. If only the certification examination and not the seminar is canceled by TestSolutions, the deadlines according to §5 continue to apply to the seminar.

Further legal claims, in particular the reimbursement of costs arising from loss of working hours, travel or hotel costs, etc., do not exist.

§5 Rebooking and cancellation

Cancellation by the customer can only be made in writing (by post, fax or e-mail).

Cancellations up to four weeks before the start of the seminar are free of charge.

Cancellations at shorter notice, no-shows at the seminar or only partial attendance of the seminar will be charged in full.

The nomination of a substitute participant by the customer before the start of the seminar is possible free of charge.

§6 Copyright of the seminar documents

All seminar documents provided are for the personal use of the participant only. TestSolutions (or its licensor) reserves the rights to the seminar documents, including translation, reprinting and reproduction. No part of the seminar documents may be reproduced, duplicated, processed using electronic systems or distributed by third parties for any purpose whatsoever without the written permission of TestSolutions.

§7 Data protection

If a customer falls under the personal scope of protection of the Federal Data Protection Act, he agrees to the processing of the data, insofar as they are necessary for the proper execution of the seminar.

The data received with the registration will be stored for internal purposes using automatic data processing tools.

The customer agrees to the forwarding of the following personal data to third parties:

• To register for the certification examination: forwarding of participant information (title, first name, surname, e-mail address) to iSQI GmbH, Potsdam.
• To create an account on our e-learning platform: Forwarding of participant information (title, first name, surname, e-mail address) to Epignosis UK Ltd, London.

No other data will be passed on.

§8 Liability

To the extent permitted by law, liability claims against TestSolutions are excluded.

§9 Collateral agreements

All ancillary agreements must be made in writing to be valid.

§10 Place of fulfillment and jurisdiction

The place of jurisdiction for all disputes arising from this contractual relationship is Frankfurt am Main.

The law of the Federal Republic of Germany shall apply.
